A DUI charge is based upon a person’s ability to operate a vehicle and/or their blood alcohol concentration (BAC).  Under Arizona State law, any driver who is pulled over and determined to have a blood alcohol content (BAC) level over 0.08% is considered to be intoxicated and can be charged with driving under the influence (DUI). For commercial truck drivers, this number lowers to 0.04% and for any driver under the age of 21, any trace of alcohol can result in a DUI. Arizona maintains a statute that defines the different classifications of DUI; that Statute is ARS 28-1381.
